    The Subcommittee met, pursuant to notice, at 1:10 p.m., in room 2255, Rayburn House Office Building, Hon. Edward Royce (chairman of the Subcommittee) presiding.
    Mr. ROYCE. The Subcommittee on Africa meets today in open session pursuant to notice to mark up House Concurrent Resolution 130, relating to the situation in Kenya. This resolution was introduced by Mr. Hastings and was referred by Chairman Gilman to this subcommittee.
    This resolution concerns the troubling conditions prevailing in Kenya in the run-up to its next general elections. Violence in July surrounding pro-democracy demonstrations claimed lives, as has recent ethnic violence. This subcommittee held a hearing on Kenya in July in the aftermath of the initial bloodshed. While the situation has calmed somewhat, there is fear that as the time nears for upcoming elections, there will be another outbreak of violence.
    The resolution by Mr. Hastings, which I support, puts Congress on record as not only noting this serious situation, but also calls for remedies. The Chair lays the resolution before the Subcommittee. The clerk will report the title of the bill.
    Ms. GAWRONSKI. House Concurrent Resolution 130, concerning the situation in Kenya.
    Mr. ROYCE. Without objection, the clerk will read both the preamble and the operative language of the resolution for amendment.

    Mr. ROYCE. Without objection, the resolution will be considered as having been read and as being open to amendment at any point.

    Mr. ROYCE. Is there any objection? Without objection, it is so ordered.
    Are there any amendments?
    Mr. MENENDEZ. Mr. Chairman.
    Mr. ROYCE. Yes, Mr. Menendez.
    Mr. MENENDEZ. Mr. Chairman, first of all, I want to commend you for having this resolution go up before the Subcommittee. I also want to commend our colleague, Mr. Hastings, who is on the floor at this moment voting, as we need to be in a few minutes, for his movement of this resolution. In the interests of time, since we have a vote, I have a full statement in the record which I ask to be included by unanimous consent. I also have an amendment that I want to offer in the nature of a substitute by Mr. Hastings, which I believe has the concurrence of the Chair, and ask unanimous consent to include his statement in support of the amendment for the record.
    I would also ask as a final unanimous consent, Mr. Chairman, that all Members be permitted to have five legislative days to include their statements in the record on this resolution.
    Mr. ROYCE. Agreed.
    The clerk will report the amendment in the nature of a substitute.
    Ms. GAWRONSKI. Amendment in the nature of a substitute offered by Mr. Hastings: Strike all that precedes the resolved clause——
    Mr. ROYCE. The amendment in the nature of a substitute is considered as having been read and is open to amendment at any point.

    Mr. ROYCE. There are no further amendments I take it? If there are no further amendments to the amendment in the nature of a substitute, the question is on the amendment. As many as are in favor of the amendment say aye.
    As many as are opposed say nay.
    The ayes have it.
    The Chair now recognizes Mr. Menendez for a motion.
    Mr. MENENDEZ. This is the true spirit of bipartisanship.
    Mr. ROYCE. It is indeed, Mr. Menendez.
    Mr. MENENDEZ. This is the one subcommittee we can get along with in this House, at least with two of us, to the Chairman's credit.
    I move that the Subcommittee report the resolution to the Full Committee with a favorable recommendation.
    Mr. ROYCE. The question is on the motion of the gentleman from New Jersey. As many as are in favor of the motion say aye.
    As many as are opposed, say no.
    It's unanimous. The ayes appear to have it. The ayes do have it.
    We will recess now. When we reconvene, we will proceed with the hearing at that time. Thank you very much.
